Terms and conditions of sale
Article 1: Purpose and scope
These Terms and Conditions of Sale (T&Cs) govern the contractual relations between ROZFLEURS (SARL with share capital of €1,500, SIRET 942 806 860 00014), an online florist headquartered in Montpellier (34), and any customer placing an order on the rozfleurs.fr website.
Any order implies full and unreserved acceptance of these T&Cs. ROZFLEURS reserves the right to amend them at any time; the applicable T&Cs are those in force when the order is confirmed.
Article 2: Products
The bouquets and floral arrangements offered are made by hand. Owing to the perishable nature of fresh products and seasonal variations, the visuals shown on the site are indicative. Substitutions with flowers of equivalent colour and quality may be made, without changing the price or the spirit of the bouquet.
The prices shown are in euros, all taxes included. ROZFLEURS reserves the right to change its prices at any time; the applicable price is the one shown when the order is confirmed.
Article 3: Ordering
The order is confirmed after:
- Selecting the product(s) and the desired size;
- Entering the delivery address;
- Choosing the delivery method and, for the local zone, a time slot;
- Accepting these T&Cs;
- Order confirmation.
A summary confirmation email is sent to the address given when ordering. ROZFLEURS reserves the right to cancel any order in the event of a stock shortage, force majeure or an obvious pricing error.
Article 4: Price and payment
Payment method (V1): payment is made in cash or by cheque payable to “ROZFLEURS”, directly to the courier when the bouquet is handed over. No bank prepayment is required.
If payment is refused on delivery, the bouquet will be taken back by the courier and the order cancelled. Travel costs may be charged.
Article 5: Delivery
Minimum order amount
Any delivered order is subject to a minimum amount of €40.00 incl. tax, excluding delivery fees.
Local delivery zones
ROZFLEURS delivers on local rounds in the following zones. Delivery fees are determined by the destination town:
- Zone 1 — Sommières & Sud-Gard — €9.00 incl. tax, delivery les mardis, mercredis, jeudis, vendredis et samedis.
- Zone 2 — Nord de Montpellier — €15.00 incl. tax, delivery les mardis, mercredis, jeudis, vendredis et samedis.
- Zone 2 — Montpellier — €15.00 incl. tax, delivery les mardis, jeudis et samedis.
- Zone 3 — Nîmes, Lunel & littoral — €20.00 incl. tax, delivery les mardis, mercredis, jeudis, vendredis et samedis.
The detailed list of towns served is available on the Delivery & zones page, which is authoritative. The time slot is chosen by the customer when ordering, from the slots available for their zone.
Fresh flowers cannot be shipped: an order containing them can only be delivered to an address within one of the delivery zones. An order mixing fresh flowers and shippable items cannot be split.
Beyond the delivery zones
For weddings, events and decoration services, ROZFLEURS may work outside its delivery rounds. These services are subject to a prior quote and are not covered by these delivery conditions.
ROZFLEURS cannot be held responsible for delivery delays attributable to external circumstances (weather, strikes, force majeure). If the recipient is absent, a new delivery attempt will be arranged as soon as possible.
Article 6: Right of withdrawal
In accordance with article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to goods liable to deteriorate or expire rapidly, which is the case for cut flowers and fresh floral arrangements.
Consequently, any confirmed order is firm and final. However, in the event of an obvious quality problem on delivery (spoiled bouquet, wrong product), I invite you to contact me within 24h of receipt, with supporting photos, at contact@rozfleurs.fr. A solution will be offered on a case-by-case basis (credit note, replacement).
Article 7: Liability
ROZFLEURS cannot be held responsible for indirect damage resulting from the use of the site or the inability to access it. ROZFLEURS's liability is limited to the amount of the order concerned.
Article 8: Personal data
The data collected when ordering is necessary for processing and delivery. It is processed in compliance with the GDPR, detailed in my Privacy policy.
Article 9: Mediation and disputes
In the event of a dispute, the customer may use, free of charge, the relevant consumer-mediation service. These T&Cs are subject to French law. Failing an amicable resolution, the courts of Montpellier shall have sole jurisdiction.
